WAVELENGTH APP

These Terms of Use (Terms) govern your access to and use of the Wavelength mobile application (the “App”) available on iOS and Android devices. The App is owned and operated by Auraline Intelligence Private Limited (CIN: U62099KA2025PTC209755), a company incorporated under the Companies Act, 2013, having its registered office at WeWork Prestige Atlanta, Bangalore – 560034, Karnataka, India (referred to as “Wavelength”, “We”, “Our”, or “Us”). For the purposes of these Terms, “User”, “You”, or “Your” means any individual who accesses, browses, registers on, or uses the App in any manner.

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy available at the App as well as at https://www.heywavelength.com/privacy (Privacy Policy), which is incorporated herein by reference. If you do not agree, you must not use the App.

  1. ELIGIBILITY AND ACCOUNT

  1. Age Requirement.  You must be at least 18 years of age to use the App. By creating an account, you represent and warrant that you are 18 years of age or older. We reserve the right to request documentary proof of age at any time. Any account found to belong to a person under 18 will be immediately suspended and terminated and all data associated with such account will be deleted without notice.

  2. Account Obligations. You agree to:

  • provide accurate, complete, and current information at all times;

  • maintain the security and confidentiality of your login credentials;

  • notify Us immediately at support@heywavelength.com  if you suspect any unauthorised use of your account; andif you suspect any unauthorised use of your account; and

  • be solely responsible for all activity that occurs under your account.

  1. One account per User: You may only create one account per individual. Accounts are personal, non-transferable, and may not be shared, sold, or used for commercial purposes.

  2. Identity Verification: We reserve the right to verify your identity through documentary or biometric means, request re-verification at any time, and suspend or terminate accounts that fail verification or that violate these Terms.

  3. Demo Login.  The App may offer a demo login feature that allows prospective users to explore limited functionality without creating a registered account. Use of the demo login does not constitute account creation. Any data entered during a demo session is not associated with a registered profile and is not retained on our servers beyond the active demo session. Full functionality, including artificial intelligence (“AI”) assisted onboarding and matching, is only available to registered users.

  1. NATURE OF THE SERVICE

  1. Platform Description:  Wavelength is an AI native compatibility and matchmaking platform designed to replicate the nuances of a human matchmaker. The App uses large language models (“LLMs”) and related AI technologies to analyse User inputs and generate potential matches based on multi-dimensional compatibility.

  2. Core Features. The App provides:

  • AI-assisted onboarding through an interactive conversational agent (“Wave”);

  • compatibility simulations and scoring based on parameters including education, career, hobbies, interests, attraction preferences, relationship expectations, and personal boundaries;

  • facilitated introductions and interactions between matched Users; and

  • a demo login mode for prospective users.

  1. Acknowledgements.  You acknowledge that:

  • matches are generated algorithmically and are indicative of compatibility based on the information You provide;

  • compatibility results are not guarantees of compatibility, relationship success, or any other outcome and;

  • We do not guarantee any specific number of matches, interactions, or relationships.

  1. ONBOARDING AND USER INPUTS

  1. Onboarding Process. The App requires completion of an AI-assisted onboarding process, which involves an interactive conversation with Wave, Our AI agent. The onboarding process is designed to gather information necessary to generate meaningful compatibility assessments and may take a significant amount of time. Upon completion of the onboarding process, the App will generate a personalised profile of You based on Your responses and interactions with Wave ("User Profile"). The User Profile will be used by the App to generate compatibility assessments and match recommendations.

3.1A User Profile- Disclaimer on Accuracy. The User Profile is generated algorithmically based on the inputs and responses You provide during the onboarding process. While We endeavour to ensure that the User Profile reasonably reflects the information You have provided, We do not warrant or represent that the User Profile will be accurate, complete, or a true reflection of Your personality, preferences, or character. The User Profile is intended to assist with compatibility assessments only and should not be relied upon as a definitive or clinical assessment of any kind. We shall not be liable for any decisions made by You or any third party in reliance on the User Profile.

  1. Data You Provide.  During onboarding and use of the App, You will be asked to provide the following categories of information:

  1. Mandatory profile information (required for account creation):

  • full name;

  • age and date of birth;

  • gender;

  • a minimum of five (5) photographs; and

  • a verification selfie.

  1. Onboarding inputs (required for core matching functionality):

  • voice-based responses through AI-assisted interaction with Wave;

  • preferred age range of potential matches;

  • type of relationship sought;

  • past relationship history (e.g., prior romantic experience);

  • approximate location (exact location is not mandatory);

  • height;

  • religious beliefs and openness to dating across religions;

  • personal habits and lifestyle choices, including vices (for self and preferences in a partner);

  • career and educational details (including workplace and institution); and

  • personal boundaries and preferences.

  1. Optional Information:

  • additional photographs beyond the minimum required;

  • social media profile links; and

  • any other information you choose to provide.

  1. Mandatory vs. Optional Fields.  Certain fields marked as mandatory are required to enable core matching functionality. Optional fields may be skipped. The App uses an adaptive threshold, where at least 80–90% of the onboarding profile has been completed, Wave may proceed with generating compatibility assessments. Incomplete profiles may result in reduced match quality or limited platform access.

  2. Accuracy of Information.  You are solely responsible for the accuracy, completeness, and currency of all information you provide, including the information provided during the onboarding process that forms the basis of Your User Profile. Providing false or misleading information is a violation of these Terms and may result in suspension or termination of Your account.

  3. Voice Responses.  Voice responses are processed to generate text transcripts for compatibility analysis. Voice recordings are retained only for as long as necessary for such processing, unless retention is required under applicable law, as further described in the Privacy Policy. 

  1. AI FEATURES AND PROCESSING

  1. AI Agent-Wave.  The App uses an AI-powered conversational agent called Wave, which analyses your onboarding inputs and ongoing interactions to generate compatibility scores, match suggestions, and related insights. Wave is built on large language model technology and operates under parameters set by Wavelength.

  2. Third-Party AI Processing.  To deliver Wave’s functionality, certain User data is processed by third-party LLM providers. The following applies to such processing:

  • Your text transcripts and preference data are sent to Our LLM providers including Anthropic, Google, Elevenlabs and Deepgram as further described in the Privacy Policy.

  • We do not share Your name, phone number, email address, photographs, or voice recordings with Our third-party LLM providers, except as necessary under applicable law, as further described in the Privacy Policy;

  • Our LLM providers are contractually bound to process Your data solely for the purpose of providing the App’s functionality and are prohibited from using your data to train their own models; and

  • Our LLM providers are required to maintain security protections equivalent to or greater than those described in Our Privacy Policy.

  1. AI-Generated Outputs.  All compatibility scores, match suggestions, conversational responses from Wave, and other AI-generated outputs:

  • are generated algorithmically and may be inaccurate, incomplete, or not reflective of actual compatibility;

  • are provided for informational and experiential purposes only;

  • should not be relied upon as professional advice of any nature (including psychological, medical, or legal advice); and

  1. No Guarantee of Quality. You acknowledge that the quality and relevance of AI-generated matches depends directly on the completeness and accuracy of the information You provide during onboarding.

  2. Algorithmic Bias. You acknowledge that AI systems may reflect inherent algorithmic biases arising from training data or model design. Wavelength takes reasonable steps to minimise bias in its matching algorithms, but cannot guarantee that AI outputs will be entirely free from bias.

  1. PERSONAL DATA, CONSENT, AND SENSITIVE DATA

  1. Nature of Data Collected.  The App collects and processes personal data in connection with Your use of the App, including during the onboarding process. The categories of personal data collected, the purposes for which it is processed, and Your rights in relation to such data are set out in Our Privacy Policy, which forms part of these Terms and should be read in conjunction with them.

  2. Consent. By affirmatively completing the onboarding process and creating an account, You provide your free, specific, informed, unconditional, and unambiguous consent (as required under the DPDP Act, 2023) to:

  • the collection, storage, and processing of Your personal data as described in these Terms and Our Privacy Policy;

  • the processing of Your text transcripts and anonymised preference data by Our designated third-party AI service provider(s) for the purpose of generating compatibility assessments; and

  • the use of aggregated and de-identified data for research, analytics, and service improvement.

  1. Rights as a Data Principal.  Under the DPDP Act, 2023, You have the following rights in respect of Your personal data:

  • the right to access a summary of Your personal data processed by Us;

  • the right to correct or update inaccurate or incomplete personal data;

  • the right to erasure of Your personal data (see Section 6 below);

  • the right to grievance redressal (see Section 17 below); and

  • the right to nominate another individual to exercise Your data rights in the event of Your death or incapacity.

  1. Withdrawal of Consent. You may withdraw Your consent at any time by deleting Your account as described in Section 6. Withdrawal of consent will result in the cessation of all data processing activities, subject to the limited retention exceptions set out in Section 6.3. Please note that withdrawal of consent will result in loss of access to the App and all its features.

  2. Third-Party Logins.  If You register or log in using a third-party social media account (including Google, Facebook, Instagram, Twitter, or LinkedIn), we may collect personal data associated with that account, such as Your name and email address. Your use of such third-party login is subject to the respective platform’s terms and privacy policy.

  1. ACCOUNT DELETION AND DATA ERASURE

  1. Right to Delete. You may delete Your account at any time through the App by navigating to Profile → “Delete” Profile. You may also initiate a deletion request by emailing support@heywavelength.com   if You are unable to access the App.

  2. Verification. To protect Your security, We will verify Your identity via OTP or phone call to Your registered mobile number before permanently processing the deletion request.

  3. Effect of Deletion. Upon successful verification and processing of Your deletion request:

  • Your profile, photographs, voice transcripts, relationship preferences, chat history, and all personally identifiable information will be permanently deleted from Our active systems upon processing of the verified request, unless retention is required under applicable law as further described in the Privacy Policy;

  • Your access to the App will be immediately terminated; and

  • any pending match interactions will be cancelled.

  1. Limited Retention Exceptions.  Notwithstanding Section 6.3, We may retain certain limited data beyond account deletion in the following circumstances and for the following maximum periods subject to the Privacy Policy:

  • fraud prevention and security logs, for as long as necessary to detect and prevent unauthorised activity;

  • data required for compliance with applicable legal obligations or ongoing legal proceedings, for the duration of such obligations or proceedings; and

  • data required to enforce Our legal rights in relation to any dispute initiated prior to deletion, until resolution of such dispute.

  1. Re-Registration. If You choose to re-register after deleting Your account, You will be required to complete the onboarding process again as a new User. We will not restore previously deleted data.

  1. PAYMENTS

    1. Free Access and Future Charges. The App is currently provided free of charge for account creation, onboarding, and browsing. We do not charge a subscription fee at this time. Charges may become applicable in the future when Users mutually agree to interact or connect with a matched profile, as communicated within the App at that time. Any such charges will be clearly disclosed to You before You are required to pay, in accordance with applicable consumer protection law.

    2. Payment Processing. If charges are introduced, payments will be processed through third-party payment providers. We do not store Your payment card details. Your use of any payment service will also be subject to the payment provider’s terms and conditions.

    3. Refunds. Any refund policy applicable to paid features will be communicated to You at the time of purchase and will comply with the Consumer Protection Act, 2019 and applicable RBI guidelines.

  2. USER CONDUCT AND COMMUNITY STANDARDS

    1. Prohibited Conduct.  You agree not to:

  • create false, misleading, or fake profiles or impersonate any individual or entity;

  • upload photographs of any person other than Yourself, or photographs that are not genuine;

  • engage in any form of harassment, abuse, stalking, threats, or harmful behaviour towards any other User;

  • post, transmit, or share unlawful, obscene, defamatory, discriminatory, or sexually explicit content;

  • use the App for commercial solicitation, advertising, spam, or any unauthorised commercial purpose;

  • attempt to contact other Users outside the App using information obtained through the App, without their explicit consent;

  • attempt to reverse-engineer, scrape, or extract data from the App or its underlying systems;

  • use automated tools, bots, or scripts to access or interact with the App; or

  • circumvent any security measures, age verification processes, or account restrictions.

  1. Zero-Tolerance Policy. We maintain a zero-tolerance policy for abusive, harmful, or discriminatory behaviour. Any breach of Section 8.1 may result in immediate account suspension or termination without notice.

  2. Content Moderation. We reserve the right to monitor, review, and remove any content posted on the App, and to suspend or terminate accounts, at Our sole discretion and without prior notice, where We determine that a violation of these Terms has occurred or is likely to occur.

  3. Reporting.  If You encounter any User or content that violates these Terms or that You believe poses a risk to Your safety or that of others, please report it to Us at vinit@heywavelength.com. We will investigate and take appropriate action within a reasonable time.

  1. SAFETY AND INTERACTIONS

    1. No Background Checks. We do not conduct criminal background checks or identity verification beyond the selfie verification process carried out during onboarding. We do not guarantee the identity, character, intentions, or behaviour of any User.

    2. Profile visibility: Certain elements of Your profile, including photographs, first name, age, and compatibility-related information, may be visible to other Users where a match is generated or where You choose to interact, as further described in the Privacy Policy.

    3. Exercise Caution. You agree to exercise reasonable caution and good judgment when interacting with other Users, both within the App and, in particular, when meeting in person. 

    4. User Responsibility.  Any interactions, meetings, or relationships between Users are undertaken at Your own risk. Wavelength is not liable for any harm, loss, or damage arising from such interactions.

    5. Reporting Safety Concerns. If You encounter any situation that poses an immediate risk to Your safety or the safety of another person, please contact local law enforcement immediately. You may also report safety concerns to Us at vinit@heywavelength.com

  2. INTELLECTUAL PROPERTY

    1. Ownership. All rights in and to the App, including its software, source code, design, user interface, trademarks, trade names, logos, content, and documentation, are owned by or licensed to Wavelength and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.

    2. Limited Licence. Subject to these Terms, We grant You a limited, non-exclusive, non-transferable, revocable licence to access and use the App on Your personal device for Your personal, non-commercial use. This licence does not include any right to:

  • copy, modify, or create derivative works of the App;

  • reverse-engineer or decompile any part of the App; or

  • use the App’s content, trademarks, or proprietary materials for any commercial purpose.

  1. User Content. By uploading photographs, voice inputs, or other content to the App, You grant Us a non-exclusive, royalty-free, worldwide licence to use, store, process, and display such content solely for the purpose of operating and improving the App. You represent and warrant that You own or have the right to grant this licence and that Your content does not infringe the rights of any third party.

  1. THIRD-PARTY SERVICES AND LINKS

    1. Third-Party Integrations. The App integrates with third-party services, including AI processing providers, analytics tools, payment processors, and third-party login providers (Google, Facebook, Instagram, Twitter, LinkedIn). Your use of these services is governed by their respective terms and privacy policies, over which We have no control.

    2. No Endorsement.  The inclusion of any third-party service or link within the App does not constitute an endorsement, recommendation, or warranty by Wavelength. We are not responsible for the availability, accuracy, or content of any third-party service.

    3. Third-Party Liability. We shall not be responsible or liable for any loss or damage arising from Your use of or reliance on any third-party service.

  2. APP STORE COMPLIANCE

    1. Platform Terms.  Your download and use of the App is subject to the terms and conditions of the platform through which You obtained it, including the Apple App Store Terms of Service and Google Play Store Terms of Service, as applicable.

    2. Platform Provider Responsibility.  Apple Inc. and Google LLC are not party to these Terms and are not responsible for the App or its content. They have no obligation to provide any maintenance, technical support, or warranty in connection with the App. Any claims relating to the App must be directed to Wavelength and not to Apple or Google.

    3. Automatic Download.  The App may be set up for automatic download and updates through the App Store or Google Play. You are responsible for ensuring Your device settings are configured in accordance with Your preferences.

  3. SUSPENSION AND TERMINATION

    1. Termination by Us.  We may suspend or terminate Your account and access to the App, with or without prior notice, if:

  • You violate or breach any provision of these Terms;

  • Your use of the App poses a risk to other Users, third parties, or the platform;

  • We are required to do so by applicable law or a government authority; or

  • We determine that You have provided false information during registration or onboarding.

  1. Effect of Termination. Upon termination of Your account (whether by You or by Us), Your access to the App will be immediately revoked. Data deletion following termination will be handled in accordance with Section 6.

  2. Termination by You. You may terminate Your use of the App at any time by deleting Your account in accordance with Section 6.

  3. Survival.  Provisions of these Terms that by their nature should survive termination (including Sections 5, 10, 14, 15, and 16) will remain in effect after termination.

  1. DISCLAIMER AND LIMITATION OF LIABILITY

    1. “As Is” Basis.  The App is provided on an “as is” and “as available” basis without any representations or warranties, express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

    2. Disclaimer of Warranties.  To the fullest extent permitted by applicable law, We disclaim all warranties and conditions of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of AI outputs, and non-infringement.

    3. Limitation of Liability. To the maximum extent permitted by applicable law, Wavelength, its directors, employees, agents, and affiliates shall not be liable for:

  • any harm, loss, or damage arising from interactions between Users, whether online or offline;

  • inaccuracies, errors, or omissions in AI-generated outputs, compatibility scores, or match suggestions;

  • any reliance placed by You on information or outputs generated by the App;

  • any loss of data, profits, goodwill, or business opportunity; or

  • any indirect, incidental, special, punitive, or consequential damages of any nature.

  1. Consumer Rights.  Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019, to the extent applicable.

  1. GRIEVANCE REDRESSAL

    1. Grievance Officer.  We have designated a Grievance Redressal Officer to address complaints relating to the App and the handling of Your personal data:

  • Response Time: We will acknowledge Your complaint within 24 hours and resolve it within 30 days of receipt.

  1. Takedown Requests. If You believe any content on the App infringes Your intellectual property rights or violates applicable law, please submit a takedown request to vinit@heywavelength.com with full particulars of the alleged infringement. We will act on valid requests within the timelines prescribed under applicable law.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

    1. Governing Law. These Terms are governed by and shall be construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

    2. Jurisdiction. Courts located in Bangalore, Karnataka, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or Your use of the App.

    3. Dispute Resolution.  In the event of any dispute, You agree to first attempt to resolve the matter by contacting Our Grievance Redressal Officer at vinit@heywavelength.com. If the dispute is not resolved within 30 days, either party may pursue remedies available under applicable law.

    4. Consumer Forum. Nothing in these Terms limits Your right to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or any other statutory forum or regulatory authority.

  2. CHANGES TO THESE TERMS

    1. We may update or modify these Terms from time to time to reflect changes in applicable law, Our services, or Our business practices.

    2. We will notify You of material changes by:

  • posting the revised Terms on the App and Our website with an updated “Last Updated” date; and

  • sending a notification to the email address or mobile number registered with Your account at least 7 days prior to the changes taking effect.

  • Your continued use of the App after the effective date of any updated Terms constitutes Your acceptance of such changes. If You do not agree with any changes, You must stop using the App and delete Your account.

  1. MISCELLANEOUS

    1. Entire Agreement. These Terms, together with Our Privacy Policy, constitute the entire agreement between You and Wavelength in relation to Your use of the App and supersede all prior agreements, representations, or understandings.

    2. Severability. If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

    3. Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

    4. Language. These Terms are written in English. In the event of any inconsistency between an English version and any translated version, the English version shall prevail.

    5. Force Majeure. We shall not be liable for any failure or delay in performance of Our obligations under these Terms due to circumstances beyond Our reasonable control, including natural disasters, government actions, cyberattacks, or failures of third-party infrastructure.
